Spirits Restaurant and Bar is facing a personal injury lawsuit filed by a customer who injured their head after a light fixture fell on them.
According to the lawsuit, Cameron Corbett was celebrating his birthday when a light fixture fell from the ceiling and hit him directly in the face and head. Corbett’s injury lawyer reports that he suffered a concussion and required multiple stitches to repair a “large gash” on his forehead. The incident occurred last year on June 6th, 2016.
Corbett is currently seeking $25,000 in damages.
The injury claim comes only two weeks after an underaged woman fell from the bar’s second-floor balcony.
Who’s Liable When an Injury Occurs?
Liability is defined as being responsible for an event and is a word that’s particularly used in a legal context. If you’ve been hurt, whether it was an auto accident, slip and fall, or another event, you can sometimes file a liability claim if another party was involved in the accident. In a liability lawsuit, another individual can be held responsible for your injury, which often leads to them being required to pay for your medical bills, lost wages, and any other costs involved with your injury.
Not every injury is accompanied by liability. If you burned yourself after spilling your own hot coffee inside your home, you probably can’t file an injury lawsuit. On the other hand, if you burnt yourself after the coffee pot shattered due to a product defect, then you may be able to hold the manufacturer accountable.
In general, manufacturers and businesses can be held accountable for injuries sustained from using their products or patronizing their stores.
In Cameron Corbett’s case, the light fixture may have been an accident but the bar is still responsible for ensuring the safety of their customers.
Because injury law varies state by state, it’s not always easy to determine if there is fault involved in an injury. Sometimes you may be able to file a lawsuit against a manufacturer instead of the person directly responsible or even both.
Therefore, it’s always important to seek out a consultation with a personal injury lawyer if you were hurt in an accident, even if you believe it was your own fault.
