Baseball Team Settles Traumatic Brain Injury Lawsuit

The Atlanta Braves and Major League Baseball have agreed to settle for an undisclosed amount as the 5-year injury lawsuit comes to an end.  In 2010, Fred Fletcher and his 6-year-old daughter were sitting in the stands at Turner Field when a foul ball came flying their way, hitting his daughter directly in the head and shattering her skull in 30 different places.

According to the lawsuit, the girl’s medical bills for her traumatic brain injury have totaled $66,439. Fletcher filed the injury lawsuit in 2012.

Personal Injury Statute of Limitations in Ohio

Although the child’s injury occurred in 2010, Fletcher was still able to file an injury lawsuit thanks to Ohio’s statute of limitations. In Ohio, the statute of limitations for personal injury is 2 years from the date of injury. However, if the injured person doesn’t know of the injury, the statute of limitations will begin when they first become aware of it.

Not all personal injury claims have a 2-year statute. For example, assault and battery only have a 1-year limit. Because injury law can vary based on where you live and other circumstances involved in the incident, it’s important to seek out the advice of an experienced personal injury lawyer for guidance.

How Much Is a Personal Injury Worth?

If you’ve been injured and are trying to determine how much to ask for in your settlement, you may have come across an injury settlement calculator. Unfortunately, this one-size-fits-all approach simply does not work when it comes to determining personal injury settlement amounts. Injured parties will often use the results of these calculators to ask for an amount that is too low, resulting in lost money.

Because every case is unique, you’ll only be able to receive an accurate estimation from an experienced injury attorney.

If you’ve been injured, make sure to maintain accurate records and documentation of all the costs involved in your injury. Even if you don’t plan to file a lawsuit for injury now, they could come of use later if you change your mind.
