Ohio Supreme Court Races Are Crucial

Catharin Taylor - Ohio Workers’ Compensation Law Specialist, Ohio State Bar Association

There are so many important races in this year’s midterms, it is hard to know what to focus on. The Ohio Supreme Court races are crucial and often overlooked by non-lawyers. Over the past decade the decisions coming out of the Ohio Supreme Court have been increasingly anti-consumer, anti-injured worker and anti-plaintiff.  Currently every Justice on the Supreme Court is a registered Republican. The Court is out of balance and in my opinion, corporate interests are being protected over the interests of the citizens of Ohio.

Pay Attention To Ohio Supreme Court Cases

Here is the latest example:

State ex rel. Klein v. Precision Excavating & Grading Company 2018-Ohio-3890, which overturned several cases protecting injured workers from the voluntary abandonment defense in workers compensation claims, thereby preventing injured workers from receiving total disability if they quit the job they had when injured, for any reason, such as a pre-planned move to another state, where they intended to find a new job.  The decision makes no logical sense and simply protects employers from having to pay benefits.

I personally support Judges Stewart and Donnelly for the supreme court.
