As a Social Security Disability lawyer, I see – and my colleagues see – a wide range of claims being filed. Many claims are denied, and many of these may be claims that have validity, but that were improperly processed.
The Social Security Administration (SSA) has a system for determining what benefits may be paid out. It is an objective system of evaluation, and it’s one for which we can observe the process with a reasonable degree of transparency. Every Social Security Disability lawyer should understand this evaluation system, and we at CTBC want you to understand this system as well.
There is a state agency in place called Disability Determination Services, or DDS. The DDS office determines whether the severity of your medical condition merits the awarding of benefits. Essentially, DDS looks to see if you are impaired significantly, if you are able or not to fulfill the duties of your previous job, and the extent to which you may reasonably be expected to carry out the duties of another job – given your training, your background, your age, and any limitations that you may have.
You also must have an impairment that matches a listing, or category, as defined by the SSA. Each type of condition (or ailment or injury) has its own listing, and each listing has different medical requirements that you must meet to qualify for a disability claim.
