Why Are Some First Responders Denied Workers Comp?

Cincinnati workmens comp attorneys always pay attention to workers comp controversies in other states, and this month’s news included a particularly disturbing case of benefits being denied.

In the mass shooting that happened on October 1 in Las Vegas, many first responders volunteered from surrounding areas. These brave men and women were quick to help, and even though some of these people were off-duty, their professional expertise gave them the skills and training to be of great assistance to the wounded concertgoers.

The case in question involves four sheriff deputies from Orange County, California. These California deputies were attending the concert that night, and when the shooting began, the four of them leapt into action. All four deputies were injured that night. At least one deputy was shot.

Yet, Orange County is denying these deputies’ workers compensation claims, as reported by Las Vegas’s Channel 8 CBS affiliate.

Tom Dominguez, president of the Association of Orange County Deputy Sheriffs, is advocating for the injured deputies. According to Dominguez, California state law entitles off-duty officers of the law to workers compensation whenever they protect life or property anywhere in California; however, the law does not provide any details on coverage when these officers protect life or property in other states.

“We believe California law makes no distinction of state lines,” said Dominguez. “We don’t believe police officers should have to make that distinction when a terrorist attack or a massacre like in Las Vegas occurs. They shouldn’t have to.”

For what it’s worth, the Cincinnati workmens comp attorneys in our office agree with Dominguez, and with the Orange County deputy sheriffs. Off-duty peace officers should have full access to workers compensation benefits whenever they put their lives on the line to protect other citizens. The geographical distinction of being across a state line should have no bearing on whether or not these brave volunteers should be compensated for their injuries.
