Understanding How Marriage Affects Your Social Security Benefits

Depending on the type of disability benefit you have, your income could be affected by marriage. For individuals with Social Security Insurance (SSI), your benefits are based on your income and assets. The SSA will count your new spouse’s income with yours which could lead to greatly reduced benefits or a termination of your pay if it exceeds income limitations.

If you’re receiving Social Security Disability, then marriage will not affect your benefits. However, there is one exception to this.

If your disability benefits are being received under a parent’s income, from an ex-spouse, or deceased spouse, then they may be terminated if you remarry. Because every situation is unique, there may be other options available to you. It’s always a good idea to discuss the issue with your Social Security lawyer before taking any actions that could jeopardize your benefits.
